Warranty
LENGTH OF COVERAGE
Subject to the exclusions contained herein below, Lormar-Innovo Company LLP, dba cCubed Security Company, warrants to the initial purchaser of its cCubed™ surveillance cameras and⁄or bulk text messaging system that the device and⁄software is free in defects in materials and workmanship which cause a failure in the basic operation of the unit or system for a period of one (1) year, notwithstanding any state statute which stipulates a longer period. This warranty is not transferable, and only applies to the original purchaser.
WARRANTY COMMENCEMENT DATE
This warranty period begins on the day the cCubed™ product is initially delivered to the original purchaser. The repair, replacement, or refund as provided under this express limited warranty is the exclusive remedy of the consumer and is provided in lieu of all other warranties, expressed or implied.
WHAT IS COVERED
Repair or replacement of any warranted part will be performed at no charge to the owner by cCubed Security Company. Owner is responsible for all costs associated with shipping to cCubed Security Company. Warranty shipments to the customer are free of charge. WHAT IS NOT COVERED
Water damage is specifically excluded from the warranty coverage. Furthermore, all failures caused by abuse, neglect, or improper adjustment or maintenance are not covered by the warranty.
Lormar-Innovo Company specifically disclaims any and all implied warranties, including without limitation, the implied warranties of merchantability and fitness for a particular purpose.
Terms of Use
Customer shall not use any cCubed™ device for any illegal purpose(s), as defined by federal, state, and local statute. cCubed™ devices are not qualified as fire or personal protection devices; therefore, cCubed™ devices shall not be used in any inhabited structure. Further, cCubed™ devices shall not be used as a covert listening device in any workplace or residence or any other location.
Customer agrees as a condition of purchase that no cCubed⁄Lormar-Innovo software or hardware will be reverse engineered, copied, duplicated, transferred, or transmitted, by any means, and that any such actions will cause irreparable harm to Lormar-Innovo, and that Lormar-Innovo may, at its option, seek injunctive relief in any suitable court of law should such actions occur. Any and all software provided by Lormar-Innovo may be installed on only one (1) computer at any given time. Notwithstanding the terms of this section, customer may make up to one (1) duplicate copy of provided software for backup purposes.
Cellular monthly charges and activation fees, if any, are the responsibility of the customer. Customers who order Cingular™-based CID™ units will need to supply a SIM card at the time of manufacture. Customers choosing Verizon™ and Sprint™ CID™ units will be supplied ESNs during the manufacturing process. The ESN will need to be activated by the customer prior to shipment.
For purchases of Lormar-Innovo's bulk text messaging system, if on-site setup includes more than twenty (20) message recipients, then Customer SHALL provide Lormar-Innovo an electronic copy of the recipient database, including recipient name, cellular phone number, cellular carrier name, and any additional data field(s) desired PRIOR to the on-site arrival of Lormar-Innovo personnel. Such electronic recipient database may be in an Excel, Lotus, or similar spread sheet, or in a comma separated value (text) file.
LORMAR-INNOVO COMPANY LLP AND CCUBED SECURITY COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, IN CONNECTION WITH THE FURNISHING OF CCUBED PRODUCTS. Customer agrees that any legal dispute arising from the purchase or use of cCubed™ products shall fall solely within the jurisdiction of the State of Tennessee, USA. If any portion of this Agreement is deemed contrary to statute, or is otherwise unenforceable for any reason, all remaining portions shall remain in effect unchanged. If the Company fails to exercise any of its rights hereunder, then this in no way shall affect Company's right to exercise these rights now or in the future. By purchasing cCubed™ products, Customer acknowledges that they have read this Agreement, understand this Agreement, and agree to the terms of this Agreement. This constitutes the sole agreement between Lormar-Innovo Company LLP and the Customer.
